The company Jana splet d.o.o., registered number: 8823057000 (hereinafter referred to as “we”) pays great attention to the protection of personal data. This document contains information about what personal data we process, especially about our customers and users of our online store, whether we process this data on the basis of consent given or on another legal basis, for what specific purposes we use it, to whom we can pass it on and what your rights are in connection with the processing of your personal data.

What personal data do we process?

When you use our Services, we collect various types of information about you, such as your username and password, your contact information, and other preferences. We track what items you view in our online store, through which device and which of our offers sent via e-mail interested you. Based on this, we create additional data in order to be able to provide you with offers according to your wishes and to be able to improve our online store and services in the future. If you make a purchase or create an account with us, we also process your first and last name, your orders and the information you set in your account.

We process the following personal data:

  1. identification data, which mainly includes first and last name, username and password and VAT ID, if you are a legal entity;
  2. contact data, which includes personal data with the help of which we can get in touch with you, in particular e-mail address, telephone number, delivery address, account address and your profiles on social networks;
  3. your settings, which include your account information, in particular saved shipping addresses, profiles, subscriptions to newsletters, memberships in loyalty programs, shopping lists, items searched for (“interested in”, “track price”), your ratings and comments about items and services;
  4. data about your orders, which mainly includes data about the items ordered and the method of payment, including the bank account number, as well as information about complaints;
  5. information about your online habits, including when you browse our website online, in particular information about the items and services you search for, the links you click on, the way you search and navigate through our website and information about the devices you use to access the Internet, such as the IP address and the location associated with it, the device ID, its technical parameters such as the operating system, version, screen resolution, selected browser and its version, and information obtained from cookies and similar device recognition technologies ;
  6. data about your behavior in connection with reading the messages we send you, in particular the time required to open the message and data about the devices from which you access the web, such as the IP address and the location associated with it, the device ID, its technical parameters, such as the operating system, version, screen resolution, selected browser and its version;
  7. derived data, which includes personal data obtained from your settings, data about items you purchase from us, data about your online habits and behavior in connection with reading the messages we send you; it mainly concerns data about gender, age, financial situation, consumer habits and attitude towards various articles and services;
  8. data in connection with the use of call centers or visits to the pick-up point, which mainly includes records of phone calls with the call center, identification of messages you send to us, including identifiers such as IP addresses, and recordings from video surveillance camera systems in our branch.

Why do we process personal data and why are we entitled to do so?

We process your personal data in different situations for different purposes. If you visit the websites of our online store, where we also use cookies, we use your data primarily to determine the number of visitors and improve our services. If you are registered with us, we use your data to manage your account and provide related functionality. If you make a purchase from us, we use your information to process your order, protect our legal claims and fulfill our legal obligations. With the help of your contact information and other information, we can simultaneously display and send you our personalized offers. With your consent, we pass the data on to third parties to display the offer on other websites as well as to give you access to some additional services. We have the right to process your personal data based on the preparation or execution of a contract with you, compliance with legal obligations, our legal requirements or your consent.

As part of our activity, we process personal data for different purposes and to different extents, namely:

  1. without your consent based on the performance of the contract, our legitimate interest or for the purpose of fulfilling legal obligations, or
  2. based on your consent.

What kind of data processing we can carry out without your consent depends on what purpose the relevant processing is connected with and what kind of relationship you have with us – whether you are just a visitor to our online store, register with us or buy something. We can also process your data if you are the recipient of goods or services ordered from us, if you communicate with us or visit our branch.

If you visit our online store

These types of cookies and other files are absolutely necessary for the operation of our online store. If you disable cookies on your browser, it may happen that our websites will not work properly, as a result of which we will not be able to offer you items from our offer and services.

We also store on your device:

    • track the number of visits to our websites or individual content, create statistics and reviews and measure the effectiveness of advertisements;

For the purpose of displaying customized offers and tailored advertisements within advertising and social networks on other websites outside our domain, we also forward data about your online behavior to advertising and social networks. If you do not disable the use of third-party cookies and the transmission of your data to advertising and social networks and after our warning you click on any link on our websites (outside the warning box) or click on the “I understand” button, which is an integral part of the warning, it is considered that you agree to the use of said cookies and the transmission of your data to advertising and social networks. 

Use of personal data of website visitors

If you visit the online store jjspa.eu, data about your behavior online we process based on our legitimate interest (that is, without your consent) for the purposes of:

  • acquiring data on the basis of which we can improve the online store for you in the future in order to create better conditions for shopping; our legitimate interest in this case is to improve our services to you;
  • creating statistics and reviews, especially tracking the number of visits to our websites or individual contents and measurement of the effectiveness of advertisements; our legitimate interest in this sense is to measure the effectiveness of our websites and advertising costs; for this purpose, we can obtain and use other derived data through your online behavior; or we can forward the derived data to our partners for charging the commission, as described in the chapter “Who handles your personal data and to whom we forward it”.
  • testing of new functions and applications before implementation, so that we can avoid problems with the operation of these innovations during actual operation, which could worsen your shopping experience with us; our legitimate interest in this case is the flawless operation of our services for you;
  • measures against attacks on our websites and threats to their operation and to ensure the security of your data; our legitimate interest in this case is the flawless operation of our services for you and the security of your data.

Data about your behavior on websites is not only obtained through cookies. We also supplement them with the following information:

  • The IP address of your device (the address of your device through which you communicate with other devices on the internet);
  • your device’s operating system, its version and language settings;
  • the browser you use on your device, its version and language settings;
  • web address (URL address) of the page from which you access our website.

For this purpose, we use personal data for a maximum of 38 months, the data is only stored in a pseudonymized form.

Data about your behavior on websites we process also on the basis of our legitimate interest (that is, without your consent), and this for the purpose of preparing customized offers and tailored advertisements that we display online. In this case, our legitimate interest is to offer you the best and most effective offer possible. For this purpose, we also expand the named data with the help of analysis and derive derived data from them. Based on this data, we can classify our users into different groups, with each group receiving its own tailored offers. If you then buy something else from us, we will additionally use the data about your orders for this purpose.

So if you searched for a household appliance in our online store or clicked on an offer in an e-mail we sent you, this household appliance may appear on the first page of our online store on your next visit. Depending on what kind of household appliance you were looking for, we can estimate which customer group you belong to. Based on this, we can offer you other items in our online store that we think might be of interest to you.

If you register with us

In order for us to register you, you must visit our online store. If you register, the data processing is extended as follows:

Processing based on the performance of a contract

If you create an account online at jjspa.eu, we process your identification and contact information, your settings and information about your orders (if you make a purchase from us later) based on the performance of a contract with you (without your consent), so that we can manage your user account. The contract on which our processing is based is created at the same time as your account. We use personal data for this purpose throughout the existence of your account, which you can delete at any time.

Processing based on legitimate interest

If you create an account in the jjspa.eu online store, we process your identification and contact information, your settings and information about your orders (if you later make a purchase from us, even if you make a purchase without logging into your account) and data about your online behavior and behavior when reading e-messages also on the basis of our legitimate interest (that is, without your consent), and that for the purposes of:

  • obtaining data on the basis of which we can improve our services for you in the future in order to create better conditions for shopping, especially by determining your satisfaction with our services; our legitimate interest in this case is to improve our services to you and
  • transmission of customized offers and customized advertisements, which we can send to you via e-mail, SMS messages and social networks, or communicate by phone or via other electronic devices, or send via regular mail or display on our websites; our legitimate interest in this case is the effective promotion of our products and services.

In order to be able to prepare a customized offer for you, we analyze all the above data and obtain other derived data from them, which we use for this purpose. In this way, we can also use data about your online behavior that we have obtained before your registration, and we can collect data about your online behavior even if you have not logged in (e.g. if we identify you with the help of cookies). According to this data, we can segment our users into different groups, with each group receiving its own tailored offers.

So if you searched for a household appliance in our online store or clicked on an offer in an e-mail we sent you, this household appliance may appear on the first page of our online store on your next visit. Depending on what kind of household appliance you were looking for, we can estimate which customer group you belong to. Based on this, we can offer you other articles on the website that we think might be of interest to you.

Based on our legitimate interest (that is, without your consent), we may also use your settings to test new features and applications.

For this purpose, we use your personal data during the existence of your account, which you can delete at any time.

If you make a purchase from us

In order to make a purchase from us, you must visit our online store. If you make a purchase from us, data processing is extended in the following way:

Processing based on the performance of a contract

If you make a purchase from us as a natural person, we process your personal data for the purpose of processing your order. It is about identification and contact information and information about your orders. If you have a user account with us, we can also use your settings for this purpose.

If you make a purchase from us as a representative of a legal entity, we process the same data for the same purpose based on our legitimate interest based on the conclusion and performance of a contract with the person you represent.

The use of data for the purpose of processing your order means that we use the data specifically for:

  • possibility of completing the order online, i.e. that e.g. they do not delete the items you have added to the shopping cart or the data from the order in preparation;
  • possibility of communicating with you, e.g. sending receipts for orders or warning about the shipment of items;
  • payment needs for goods,
  • goods delivery needs; in this regard, we may also pass on your data to our transport partners, exclusively for the purpose of delivering these goods, as described in the section Who processes your personal data and with whom do we share it?;
  • in relation to complaints about ordered goods or services; in this regard, we may also pass your data on to a supplier of goods or a service center, as described in the section Who processes your personal data and with whom do we share it?;
  • in connection with your other requests that you address to us, e.g. through the call center as described in If you communicate with us through different channels.

For this purpose, we use personal data for the time necessary to process your order or resolution of contractual obligations, such as complaints.

Processing based on legitimate interest

If you make a purchase from us, we keep your identification and contact information and information about your orders based on our legitimate interest (without your consent) for the purposes of protecting legal claims and our internal records and controls. Our legitimate interest in this case is the protection of legal claims and control over the regular performance of our services.

Furthermore, based on our legitimate interest (ie without your consent), we process your identification and contact information, your preferences and your order information (if you subsequently make a purchase from us) for the purposes of:

  • obtaining data on the basis of which we can improve our services for you in the future in order to create better conditions for shopping, especially by determining your satisfaction with our services; our legitimate interest in this case is to improve our services to you and
  • adapting the functions of our web domain to your needs, so that we can offer you e.g. the nearest collection points, all based on our legitimate interest based on improving and customizing our services; for this purpose, we also process your IP address and the location derived from it,
  • transmission of customized offers and customized advertisements, which we can send to you via e-mail, SMS messages and social networks, or communicate by phone or other electronic devices, or send via regular mail; our legitimate interest in this case is the effective promotion of our products and services. In order to be able to prepare a customized offer for you, we analyze all the above data (i.e. your identification and contact data and your order data) and obtain other derived data from them, which we use for this purpose. According to this data, we can segment our users into different groups, with each group receiving its own tailored offers. If you are not registered with us, we do not use data about your behavior on the websites to prepare the offers that we send you.

    So if you have purchased a household appliance from us, we can appeal to you with a tailored offer for an extended warranty. Based on your purchase, we can also conclude which customer group you belong to. Based on this, we can send you an offer for related items that may be of interest to you. If you do not have an account with us, we will not adjust the offers according to what kind of goods you searched for on our websites, nor according to which links you opened in the sent offers.

We also use data about your orders for the purpose of creating customized offers and tailored advertisements that we display on the websites.

In order to protect legal claims and maintain our internal records and controls, we process data for a period of 3 years and 1 year after that in relation to claims that are asserted by the end of the statute of limitations. In the case of legal, administrative or other proceedings, we process your personal data for the period necessary for the duration of such proceedings and for the remainder of the limitation period after its completion.

In order to protect legal claims and our internal records and control, we process data for the duration of the limitation period, which is 5 years, if necessary, one more year after its expiration in the case of an established claim at the end of the limitation period. When initiating a judicial, administrative or other procedure, we process your personal data for the time that is absolutely necessary to carry out such procedures, and until the end of the remaining part of the limitation period after its completion.

For the other stated purposes, we use personal data for a maximum of 6 months,

Processing based on compliance with legal obligations

We also have to fulfill certain obligations prescribed by law. If we process your personal data for this reason, we do not need your consent for such data processing. On this legal basis, we process your identification and contact data, order data, namely in order to comply with the applicable laws, which at the time of drafting the memorandum in question are particularly the following:

  • Obligation Code (OZ),
  • Consumer Protection Act (ZVPot),
  • Act on Value Added Tax (ZDDV-1),
  • Act on tax verification of invoices (ZDavPR),
  • Accounting Act (Act),
  • Electronic Communications Act (ZEKom),
  • Act on Prevention of Money Laundering and Financing of Terrorism (ZPPDFT-1).

For this purpose, we use personal data for a maximum of 10 years (plus the current year) after the last document issued regarding your order.

If you are the recipient of goods or services ordered from us

If you are the recipient of goods or services ordered from us, we process your identification and contact information:

  • on the basis of our legitimate interest for the purpose of preparing, concluding and implementing a contract with our client. The execution of this contract is also our legitimate interest;
  • on the basis of our legitimate interest in obtaining data on the basis of which we can improve our services for you in the future, or data for the preparation of our internal statistics and reviews; our legitimate interest in this case is to improve our services to our customers;
  • for the purpose of protecting legal claims and our internal records and control; our legitimate interest in this case is the protection of legal claims and control over the regular performance of our services.

In order to prepare, conclude and implement the contract with our customer, we use personal data during the time that is absolutely necessary to process the order. After the expiration of this time, we continue to store the data on the basis of our legitimate interest for the purpose of protecting legal claims and our internal records and control, namely for the duration of the limitation period, which is 5 years, and if necessary for another year after its expiration in the case of an established claim at the end of the limitation period. When initiating a judicial, administrative or other procedure, we process your personal data for the time that is absolutely necessary to carry out such procedures, and until the end of the remaining part of the limitation period after its completion. Our legitimate interest in this case is the protection of legal claims and control over the regular performance of our services. In order to fulfill legal obligations, we use personal data for a maximum of 10 years for a single order.

If you communicate with us through different channels:

If you communicate with us through various channels, especially via call centers, e-mail, chat rooms and social networks, your identification and contact data and records of mutual communication, including recordings of speeches, are processed on the basis of our legitimate interest (that is, without your consent) for the purposes of:

  • processing of your requests; if you have made a purchase from us and your request relates to an order, we can carry out the processing based on the execution of the contract with you;
  • records of your requests so that we can check their regular and timely fulfillment;
  • evidence that we have received and processed your request, e.g. if you order goods from us in this way or assert a complaint;
  • analysis of requirements to improve the quality of our services.

For these purposes, we store personal data for a period of 3 months. If you place orders through one of our channels, we may retain data for the protection of legal claims for a limitation period of 5 years and a further 1 year after expiry in relation to claims asserted at the end of the limitation period. In the case of legal, administrative or other proceedings, we process your personal data to the extent necessary for the duration of such proceedings and the remainder of the limitation period after its termination.

If you visit our branch or the surrounding area, we process records from the video surveillance camera system on which you may be shown, based on our legitimate interest (that is, without your consent) in order to protect our and your property and people moving in and around the store, which at the same time represents our legitimate interest.

For this purpose, we store personal data for a period of 2 months.

Who processes your personal data and with whom do we share it?

In most cases, we process your data for our own purposes as its controller. In such a case, we pass your data on to our partners to ensure payments, transport and other matters related to your order. We also forward the data to our processors, who process it in accordance with our instructions. With your consent, we can also forward the data to advertising and social networks for displaying customized ads on other websites.

All described personal data are processed by us as manager. This means that we determine the above-defined purposes for which we collect your personal data and the methods of processing, and are responsible for the appropriate implementation of this.

We may also forward your personal data to other entities that also have the function of manager, namely:

  • in relation to the processing of your order to our partners who are involved in the processing of the order, as stated in the section If you make a purchase from us, specifically
    • partners who operate payment systems for the provision of payments, especially in relation to payment cards;
    • transport partners, especially the companies Pošta Slovenije d.o.o., Gold Ekspres and GLS dostava.
    • to the supplier of the goods or to the service center of the corresponding manufacturer in connection with the complaint of the ordered goods or service;
  • based on your consent to advertising and social networks, as described in the section Use of cookies and other technologies, the transmission of data to advertising and      to social networks, namely by name:

From which sources do we obtain personal data?

We mostly obtain personal data directly from you via our online store or when communicating with you. Some other data can also be obtained from our partners, e.g. banks or transport companies.

We mostly process personal data that you provide to us directly in the context of ordering goods and services, during the creation and use of an account or when communicating with us, for example with a call center. We also obtain personal data directly from you by monitoring your online habits while browsing our online store or when reading our messages, with video surveillance cameras in and around our pick-up locations.

If you make a purchase from us, we may receive additional information about your orders from banks, our partners who manage payment systems, and transport partners, e.g. information about your account number, successfully executed payments or delivery and collection of goods.

Transfer of data outside EU countries

In some cases, we may transfer your personal data to countries that are not members of the European Economic Area.

In the context of forwarding data to recipients listed in the section Who processes your personal data and with whom do we share it?, we may also forward your data to third countries outside the European Economic Area, in which an adequate level of personal data protection is not necessarily guaranteed. Any mediation of this kind will only be carried out if the recipient in question undertakes to comply with the standard contractual provisions issued by the European Commission.

What are your rights in connection with the processing of personal data?

You have a number of rights in relation to your personal data. These include the right to access, review, erasure and restriction of processing, transfer, objection and appeal.

Just as we have our rights and obligations regarding the processing of your personal data, you also have certain rights in connection with the processing of your personal data. These rights include:

Right to know

Simply put, you have the right to find out what data we collect about you, for what purposes and for how long, from where we obtain your personal data, to whom we pass it on, who else processes it besides us, and what your other rights are in connection with the processing of your personal data. You can read all this in the document “Protection of personal data of customers”. However, if you are still not entirely sure what personal data we collect about you, you can request a confirmation from us as to whether or not we collect personal data about you, and if so, you have the right to be informed about this data. In accordance with the right to be informed, you can request a copy of the processed data from us, whereby we will provide you with the first copy free of charge, and each subsequent copy for a fee.

Right to rectification

To err is human. If you notice that the personal data we hold about you is incorrect or incomplete, you have the right to request that we correct or complete it as soon as possible.

Right to erasure

In some cases, you have the right to delete your personal data. We will delete your personal data as soon as possible if any of the following reasons are met:

  • we no longer need your personal data for the purposes for which we processed them;
  • you have withdrawn your consent to the processing of personal data, where it concerns data for the processing of which your consent is necessary, but at the same time we have no other reason for further processing of this data;
  • you have exercised your right to object to data processing (see section Right to object to data processing below) for personal data that we process on the basis of our legitimate interest, and we realize that we no longer have legitimate interests that would justify further processing of this data, or
  • you assume that the processing of personal data carried out by us is no longer in accordance with generally binding legal regulations.

However, please be aware that even if one of the described reasons is fulfilled, this does not mean that all your personal data will be deleted immediately. However, this right cannot be exercised in the event that the processing of your personal data continues to be necessary for the fulfillment of our legal obligations or for the determination, implementation or defense of our legal claims

Right to restriction of data processing

In some cases, in addition to the right to deletion, you can also exercise the right to limit the processing of personal data. This right allows you, in certain cases, to request that your personal data be specifically marked and exempted from any processing procedures – in this case, the effect is limited in time (and not permanent as with the right to erasure). We must limit the processing of personal data:

  • if you dispute the accuracy of personal data until we agree on which data is correct;
  • if we process your personal data without an appropriate legal basis (e.g. beyond the intended scope), and you will prefer only their limitation instead of deleting such data (e.g. if you assume that you will still provide us with this data in the future);
  • if we no longer need your personal data for the purposes described above, but you need them to establish, implement or defend your legal claims, or
  • if you object to data processing. The right to object is described in more detail below under the heading Right to object to data processing). During the processing of your objection, we must limit the processing of your personal data.

Right to data portability

You have the right to obtain from us all your personal data that you have provided to us and that we process on the basis of your consent (see section If you give us your consent) and on the basis of the performance of the contract. We provide you with your personal data in a structured, consistent and machine-readable format. Simple data transfer is only possible for data that is automatically processed in our electronic databases.

Right to object to data processing

Based on reasons related to your particular situation, you have the right to object to the processing of personal data based on point (e) or (f) of Article 6(1) of REGULATION (EU) 2016/679 and to object to the processing of data for direct marketing purposes. We will immediately stop processing your data for marketing activities; in other cases, we will do the same, unless we have legitimate reasons for the processing that override your rights or to assert legal claims.

Right to appeal

In exceptional cases, especially when it comes to more complex claims, we have the right to extend this deadline by two additional months.
