General terms and conditions

The general conditions of the JJSPA online store are drawn up in accordance with the Consumer Protection Act (ZVPot), the Personal Data Protection Act (ZVOP-1) and the Electronic Communications Act (ZEKom-1).

The JJSPA online store (hereinafter referred to as the “store”) is managed by the company Jana splet d.o.o., Kolodvorska cesta 16a, 1330 Kočevje, registration number: 8823057000, tax number: SI26216477, which is also a provider of e-business services (hereinafter referred to as the seller or JJSPA ).

The general business terms and conditions determine the operation of the JJSPA online store, the rights and obligations of the user and the store, and regulate the business relationship between JJSPA and the customer. The general terms and conditions of business also regulate the individual purchase rules at the pick-up points of the company Jana Splet d.o.o.

The customer is bound by the general conditions valid at the time of purchase (submission of the online order). When placing an order, the user is specifically warned about the general business terms and conditions and confirms his familiarity with them by placing the order.

Types of users

With a one-time registration in the JJSPA online store via e-mail, the visitor becomes a JJSPA guest, and with a confirmed registration in the online store, he becomes a JJSPA member. Both the guest and the JJSPA member (hereinafter also the user) acquire the right to purchase in the JJSPA online store.

The visitor can register as a JJSPA member online. Registration is also possible during the purchase process.

If the user wishes to change his e-mail address to another at any time later, he must send a request to info@jjspa.si. The change of e-mail address will be carried out on the same or the next working day at the latest, and the user will be informed about this via e-mail.

Accessibility of information

Jana splet, d.o.o. undertakes to provide the following information to the buyer even before he is bound by the contract or offer:

  1. information about the company Jana splet, d.o.o. (name and headquarters of the company, registration number and tax number),
  2. contact information that enables the user to communicate quickly and efficiently (e-mail, telephone),
  3. the essential characteristics of the items (including after-sales services and guarantees) and the validity period of this information,
  4. availability of items (every item offered on the website should be available within a reasonable time with certain exceptions – see the Prices section),
  5. terms of delivery of articles (and method, place and deadline of delivery),
  6. prices, which must be clearly and unequivocally determined and must clearly show whether they already include taxes and transport costs and other charges, as well as the validity period of this information,
  7. method of payment and delivery or fulfillment, and the validity period of this information,
  8. temporary validity of the offer,
  9. the deadline within which it is possible to withdraw from the contract and the conditions for withdrawal (description of the right to withdraw in accordance with Article 43 of the ZVPot; in cases where the consumer does not have the right to withdraw in accordance with Article 43 of the ZVPot, he is expressly informed of this),

Product offer

Due to the nature of online business, the offer of the JJSPA online store is updated and changed frequently and quickly.

The price in the JJSPA online store is displayed as Online price. The online price applies to all registered JJSPA users (that is, users who trust JJSPA with their data). You become a registered user of JJSPA by registering in the online store as a member of JJSPA or by logging into the online store once as a guest of JJSPA. At the pick-up points, individual items are available for purchase at regular prices.

The regular price is the price that applies to unregistered users who are not members of JJSPA or guests of JJSPA and who nevertheless want to make a purchase at one of the possible pick-up points / branches of Jana splet d.o.o.

Item tags

  • The article marked “New” is a newly added article to the Trgovina Jana offer. With this label, it will be exposed for a minimum of 14 days and a maximum of 2 months.
  • The item marked “Sale” has an additional reduced price compared to the online price, which is valid until the stock of this item is sold out. The discount percentage is indicated next to the item.
  • The article marked “Currently out of stock” is currently unavailable. This means that it is not in stock either in the central warehouse of JJSPA or at the supplier.
  • The article marked “Sold out” is no longer available. This means that the item will no longer be available.
  • An article marked “Great price” allows the buyer to buy the article at a particularly favorable price compared to the online price.
  • For the item with the  “Recommended” sales consultant JJSPA recommends buying it due to the features of the item and/or the excellent price. The recommendation, intended for a wider group of people, does not take into account the needs and characteristics of the individual buyer, therefore each buyer must make the purchase decision for himself and Trgovina Jana does not assume any responsibility for it.
  • The article marked “Last piece” is the last piece of this article in stock in the JJSPA central warehouse, which enables faster delivery of the article.

Order

Sales contract between Jana splet, d.o.o. and customers in the JJSPA online store is concluded at the moment when Jana splet, d.o.o. sends the first e-mail to the buyer with the status: Completed order. From this moment on, all prices and other conditions are fixed and apply both to Jana splet, d.o.o. as for the buyer. The person with the information specified when placing the order is considered a buyer. It is not possible to change the customer data later.

The sales contract (i.e. the first email with the status: Completed order) is stored in electronic form on the JJSPA server.

Methods of payment

Jana splet, d.o.o. enables the following payment methods:

  • by transfer to the account of Jana splet, d.o.o. according to the offer/estimated invoice**
  • with payment or credit card (MasterCard®, Visa, Visa Electron, BA Maestro, Diners club)*

*For individual orders, we reserve the right to request payment by bank transfer to the account of Jana Splet, d.o.o. according to the offer/proforma invoice, while the price still applies.

**After receipt of payment according to the offer/proforma invoice, the order moves on to the processing process.

In the office of Jana splet d.o.o. it is possible to pay in cash or with a payment or credit card (MasterCard®, Visa, Visa Electron, BA Maestro, Diners Club – only for holders of new cards).

When paying with a credit card online, in the event of cancellation of the order or change of payment method, please inform us at info@jjspa.si to credit the card or refund the purchase price.

Invoice issuance

Jana splet, d.o.o. after delivery of the ordered items, the invoice is also sent to the buyer in physical form by post or in pdf format to the buyer’s e-mail address. In the case of personal collection at the branch, the customer receives a printed invoice for the purchased items upon collection. The price and all costs related to the purchase are detailed on the invoice. The buyer is obliged to check the correctness of the data before placing the order. We do not take into account objections made later regarding the correctness of the issued invoices.

Prices

The online price applies to all registered users of JJSPA, who belong to the company Jana splet, d.o.o. trust your information. You become a registered user of JJSPA by registering in the online store as a member of JJSPA or by logging into the online store once as a guest of JJSPA.

All prices include VAT, unless explicitly stated otherwise.

Prices are valid at the time of placing the order and have no future validity.

The prices are valid in the case of payment with the above-mentioned payment methods, under the above-mentioned conditions.

Despite our best efforts to provide the most up-to-date and accurate information, it may happen that the price information is incorrect. In this case, or in the event that the price of the item changes during the processing of the order, Jana splet, d.o.o. allowed the buyer to withdraw from the purchase.

Discounts, promotional codes, etc. as a rule, they do not add up. The discount for the individual item and the promotional code are combined.

Deposited funds from gift vouchers, bonuses and advance invoices do not bear interest. Gift vouchers and discount bonus codes cannot be exchanged for cash.

In the office of Jana splet, d.o.o. individual items are available for purchase at a price equal to their price from the JJSPA online store. All published prices in the branch include VAT. It is not possible to redeem gift vouchers, bonuses, promotional codes, etc. when making a purchase in the branch.

Payment and credit cards

In case of payment by payment or credit cards, the following conditions also apply:

  • the payer (data in the user’s account) must be the same person or organization as the owner of the payment or credit card,
  • after confirmation of receipt of the order, it is not possible to change the content of the order or of the final amount of the order, except in exceptional cases with the approval of Jana splet, d.o.o.

Discount code

The discount code brings various advantages when purchasing through the Jana Splet, d.o.o. online store. and is limited in time. You can find the active discount code on the front page of the advertising message, on the page of the individual department, in our e-newsletter or other media.

In the event that the customer uses a discount code, but later cancels the order with the used code of his own free will, he is no longer entitled to a new benefit from this code.

You can use codes only for items delivered by Jana splet, d.o.o.

Using the discount code:

  • Select the items you want to buy and add them to your cart. The value of your order must be at least €1 higher than the value of the discount code. When you have finished adding items to your cart, continue by clicking the Checkout button. Choose a delivery method, specify a delivery address and choose a payment method.
  • In the same step, enter the discount code in the Gift voucher, promotional code, discount code field and confirm the entry by clicking the Apply button. If you want to use several discount codes at the same time, enter them in the field at the same time and separate them with a comma or a space. Then click the Apply button.

Only one discount code can be applied to the purchase of one item. The number of discount codes must not exceed the number of different items ordered (for example: when ordering 4 items, you can use a maximum of 4 different discount codes at the same time).

When you enter the discount codes, the value of the discount codes is automatically deducted from the price of your order in the last step – Order summary. There remains an amount that still needs to be settled.

The discount code is a one-time code, which means you can only use it once.

The combination of different types of benefits (discount code, promotional code and bonus) within the same order is not possible.

Purchase Notification Procedure

  1. JJSPA order

After submitting the order, the buyer receives a notification by e-mail that the order has been accepted. The JJSPA member can always access comprehensive information on the status and content of the order on the JJSPA website. Jana splet, d.o.o. reviews the order, checks the availability of the ordered items and confirms the order or rejects it with a reason. Jana splet, d.o.o. can call the customer on his contact phone number to check the data or to ensure the accuracy of the delivery. When delivering items that Jana splet, d.o.o. does not have it in stock in its own warehouse, Jana splet, d.o.o. exclusively tied to the delivery by its supplier and the time in which this supplier can deliver the item to Jana splet, d.o.o.. Through the email of Jana splet, d.o.o. keeps the customer informed of up-to-date information regarding the delivery of items. If the delivery time is very long and the buyer does not want to wait, the buyer can notify Jana splet, d.o.o., which will remove the item from the order and return any funds already paid to the buyer, and deliver the other items from the order at the buyer’s choice, or cancel the entire order . If the supplier Jana splet, d.o.o. does not confirm the delivery of the ordered items no later than two weeks from the date of placing the order, Jana splet, d.o.o. rejects the customer’s order because the item is not available. On the day of rejection, the customer’s order ceases to be valid. Jana splet, d.o.o. does not assume any responsibility for damage caused by longer delivery times or unavailability of items that Jana splet, d.o.o. does not have it in stock in its own warehouse, except to the extent that the company Jana splet, d.o.o. or a person for whom the company is responsible, caused intentionally or negligently.

  1. Order shipped / Order ready for pickup

jana splet, d.o.o. prepares, sends, or prepares the article for personal collection within the agreed period.

In the event that the buyer decides to cancel the order in time, he must notify the seller immediately on the phone number +38670 700 805 or by e-mail to the address info@jjspa.si. If it happens that the order has already been shipped, the buyer rejects the shipment to the delivery service. In the case of personal pickup (when the item is already ready for pickup), the buyer also communicates his wish to cancel the order via the above-mentioned phone number or via the above e-mail.

Purchase for legal entities

The purchase process for legal entities is exactly the same as for natural persons, except that in the first step you select the company account option and confirm your agreement to the terms of business.

If you want a business account, you accept the terms of business that apply to businesses. The main difference is the possibility of withdrawing from the contract: we allow companies, sole proprietors and other legal entities to return the delivered items within the warranty conditions. The listed legal entities do not have the option of withdrawing from the contract within 14 days of receiving the item without reason, as is the case for consumers (natural persons).

Refunds for legal entities are not possible. Purchases by legal entities are also subject to the General Business Terms and Conditions of Jana Splet, d.o.o., you can read more about return options within the warranty conditions further down the page or on the return page.

The JJSPA online store allows legal entities the following payment methods:

  • with cash on delivery*
  • by transfer to the account of the manager Jana splet, d.o.o. according to the offer/budget
  • with a payment or credit card (MasterCard®, Visa, Visa Electron, BA Maestro, Diners club)
  • with installment payment of up to 36 installments with a Diners Club card
  • deferred payment (applies to public and local administration organizations and companies that achieve the appropriate credit rating).

*In the case of individual orders, we reserve the right to request payment by transfer to Trgovina Jana’s account according to the offer/proforma invoice, while the price still applies.

Withdrawal from the contract

The consumer (the above applies exclusively to natural persons who acquire goods for purposes outside of their commercial activity) has the right to inform the company (e-mail address: info@jjspa.si) within 14 days of taking over the goods that they withdraw from the contract, without he should be given a reason for his decision. The deadline begins one day after the date of collection of the ordered item. The cost charged to the consumer in connection with withdrawal from the contract is the cost of returning the goods (which, in the case of shipping, is charged according to the price list of the delivery service and depends on whether it is a shipment/package/cargo). The consumer may also be liable for the reduced value of the goods, which is not necessary to determine the function, nature and properties of the goods. The goods must be returned to the seller no later than 14 days after the notification of withdrawal from the contract (purchase).

The customer must return the goods received undamaged and in the same quantity, unless the goods are destroyed, damaged, lost or their quantity has decreased through no fault of the consumer.

The buyer may not use the goods unhindered until withdrawal from the contract, but only has the opportunity to reconsider the purchase due to the nature of the online store (distance contract). The buyer may inspect the product and perform a test that is absolutely necessary to determine the actual condition.

For an easier understanding of the rights to return products, we quote the explanation of the market inspectorate (source: Information – Bulletin of the Chamber of Commerce of Slovenia, January 20, 2012, number 3):

When it comes to the right to withdraw from a contract concluded at a distance, it is necessary to know that it is a withdrawal from the contract, without there being anything wrong with the thing itself, but this right goes to the consumer due to the very nature of the contract – the conclusion of a contract at a distance. The right to withdraw from the contract does not mean that the consumer does not know what he is buying (in principle, the consumer also knows what he is ordering for other things), but only that he thinks about his decision within the statutory deadline and, in the event that this decision was rushed, changes his decision and withdraws from the contract. 

It should also be known that concluding a distance contract does not give the consumer more rights than concluding a contract in the classic way (that is, by visiting a store). Thus, the consumer cannot and must not use the received goods unhindered all the time until withdrawing from the contract, as this is not a trial purchase, where testing the goods would be a condition for keeping the contract in force. Thus, the consumer may inspect and test the received goods only to the extent that this is absolutely necessary to determine the actual situation and as is usually the case in stores. Any “testing” that deviates from the above can be considered as use of the goods, which means that the consumer thereby loses the right to withdraw from the contract. 

The right to withdraw from the contract does not give the consumer any more rights, but only the possibility, even after receiving the goods, to reconsider his purchase decision and, in the event that this decision was rushed, to change his decision and withdraw from the contract, but it does not give him the right to use the goods.

How does the refund process work?

Items can be returned in two ways:

  1. Personal return

In our office, Jana splet d.o.o. on Kolodvorska cesta 16a, 1330 Kočevje.

This requires: 

  • Attach a copy of the invoice for the item you are returning.
  • Prepare the article for transport. Protect the item properly before handing it over to the carrier. You must protect the item with the original packaging or packaging that can protect the item as well as the original packaging to avoid damage in transit. Do not forget to attach the data form and a copy of the invoice.
  • Restore the item to its factory settings if it is an electronic device that has this option (phones, tablets, laptops, etc.)
  1. Return by post

You can also take advantage of the return by post option. We recommend that you use a delivery service that allows you to track your shipment. Prepare the items properly for transport (you can use the original JJSPA packaging or the packaging in which you received the product or other suitable safe packaging).

Shipping costs are always borne by the sender, unless otherwise agreed in advance. We do not accept ransom payments.

When can I exercise my right to return an item within 14 days?

The possibility of withdrawing from the contract is intended so that you can open the product, examine it and if it does not suit you, or if your expectations were different, withdraw from the purchase. These recommendations do not apply if the product is defective or does not work at the time of purchase. In this case, it is about asserting a material defect or warranty. The right to a refund, warranty, material defects and improperly performed services are more precisely governed by the provisions Consumer Protection Act (official consolidated text).

Can I return an item within 14 days if I am a legal entity (business purchase)?

If you purchased an item with a business account, you have accepted the terms of business that apply to businesses. The main difference is the possibility of withdrawing from the contract: We allow companies, sole proprietors and other legal entities to return product shipments under warranty conditions. The aforementioned organizations do not have the option of withdrawing from the contract within 14 days of receiving the goods, without having to state a reason for their decision, as is the case for consumers (natural persons). Unfortunately, a refund is therefore not possible. Purchases by legal entities are subject to General terms and conditions  online store JJSPA, with the difference in the previously mentioned options, withdraws from the contract.

Which documents must I attach when accessing the contract?

To carry out the procedure for refunding the purchase price upon withdrawal from the contract or for a return within 14 days, we need a copy of the invoice for the purchased product.

When will I get my refund?

We will refund your purchase to your account as soon as possible, but no later than 14 days from your return application, but only after the items have been returned to the warehouse (in the case of returns by post).

What is the legal contract to withdraw from a contract?

The right to a refund, warranty, material defects and improperly performed services are more precisely governed by the provisions Consumer Protection Act (official consolidated text).

How do I properly check whether the article fits me so that I can still return it?

When you receive the item, first make sure that it has undamaged packaging and carefully remove the packaging. Keep the packaging until you are sure that the item fits you and that it works without problems. Check its basic functions without removing the protective films. Only remove these when you are absolutely sure that you intend to keep the item.

The consumer may not use the goods unhindered until withdrawal from the contract. He may, however, inspect and test the goods to the extent that is absolutely necessary to determine the actual situation.

Do I have to return the item in its original packaging?

In the case of returning the item, the buyer must properly protect the item before handing it over to the carrier. The item must be protected by the original packaging or packaging that can protect the item in the same way as the original packaging.

Can I return the item without accessories?

In case of withdrawal from the contract, you must return the item together with all accessories that you received together with the item, for example: cables, chargers, headphones.

When do we start counting 14 days?

When withdrawing from the contract, the 14-day period begins 1 day after taking over the item.

If I return an item for which I claimed a discount, gift certificate or other benefit, what amount do I get refunded?

When withdrawing from a contract where a bonus, discount code or promotional code has been used, these funds are considered as a discount and are not returned to the user. Only the amount paid will be returned to the user’s TRR or other means of payment, insofar as the user expressly requests this.

The gift voucher is considered as a means of payment when withdrawing from the contract, and therefore the amount of it, in case of withdrawal from the contract, is returned to the buyer.

Which items cannot be returned?

The consumer does not have the right to withdraw from the contract, for contracts the subject of which are goods that have been manufactured according to the consumer’s precise instructions, that have been adapted to his personal needs, that are not suitable for return due to their nature, that are perishable or that have already expired. The possibility of withdrawing from the contract is not possible when purchasing software or audio and video media if the consumer has opened the security seal.

Withdrawal from the contract is not possible for goods:

  • for goods or services, the price of which depends on fluctuations in the markets, over which the company has no influence and which may occur during the withdrawal period from the contract;
  • for goods that are manufactured according to the exact instructions of the consumer and adapted to his personal needs;
  • for goods that, due to their nature, are not suitable for return, are perishable or expire quickly;
  • for the service provided, if the company fulfills the contract in full and the provision of the service began based on the consumer’s express prior consent and consent to lose the right to withdraw from the contract when the company fully fulfills it;
  • sealed audio or video recordings and computer programs, if the consumer has opened the security seal after delivery;
  • sealed goods that are not suitable for return due to health protection or hygiene reasons, if the consumer has opened the seal after delivery; when buying food for small animals, if the packaging is open or damaged;
  • goods which, due to their nature, are inseparably mixed with other items;
  • digital content that is not delivered on a tangible data carrier, if the provision of the service began based on the consumer’s express prior consent and consent.

The prize obtained cannot be paid out or returned to JJSPA’s account under any circumstances.

Warranty

Items have a warranty if so stated on the warranty card or invoice. The guarantee is valid if the instructions on the guarantee sheet are followed and upon presentation of the invoice. The warranty periods are indicated on the warranty sheets or on the invoice. 

Guarantee information is also provided on the item presentation page. If there is no warranty information, the item does not have a warranty or the information is currently unknown. In the latter case, the buyer can contact Jana splet, d.o.o., who will provide up-to-date information.

Real error

The consumer can assert his rights from a material defect if he informs the seller about the defect within two months from the day the defect was discovered. In the error notification, the consumer must describe the error in detail and allow the seller to inspect the item.

The seller is not responsible for material defects in the goods that appear after two years have passed since the item was delivered. A defect in the goods is considered to have already existed at the time of delivery, if it appears within six months of delivery.

The consumer, who has correctly informed the seller about the error, has the right to demand from the seller that:

  • correct the defect in the goods or return part of the amount paid in proportion to the defect or
  • replaces defective goods with a new flawless one or
  • returns the amount paid.

When is an error real?

When:

  • the article does not have the properties necessary for its normal use or for circulation
  • the article does not have properties that are necessary for the specific use for which the buyer is buying it, but which was known or should have been known to the seller
  • the article does not have properties and features that have been expressly or tacitly agreed or prescribed
  • the seller has delivered an item that does not match the sample or model, unless the sample or model was shown for notification only.

How is the suitability of the item checked?

It is checked with another, faultless item of the same type, and at the same time with the manufacturer’s statements or indications on the item itself.

How is the actual error enforced?

The buyer must notify us of a potential material defect along with a precise description of it within the statutory deadline and at the same time allow us to inspect the item. The right to assert a material defect on the item is more precisely regulated by the provisions of the Consumer Protection Act.

Acceptance of items returned due to warranty or material defect

The buyer is obliged to take over the item, which he handed over to the seller for warranty or other treatment, after the treatment has been completed. The buyer collects the item at the pick-up point where he personally handed it over to the seller, and if he sent it by post, it will be returned to him at the delivery address.

The seller sends a notification to the buyer about the return of the item from consideration and invites him to pick up the item. The buyer is obliged to collect the article within 14 days from the date of notification.

If the buyer does not collect the item within the specified period, the item is handed over to the seller for safekeeping at the address of his warehouse: Jana splet d.o.o., Kolodvorska cesta 16a, 1330 Kočevje. The seller keeps the article in its own warehouse until the expiration of 6 months from the date of notification. For this period, the seller has the right to reimbursement of all storage costs (€1/day) and the right to reimbursement of all costs necessary to preserve the item.

After 6 months from the date of notification, the seller can sell the item through the JJSPA online store and transfer the purchase price to the buyer after deducting the seller’s sales and other expenses. In the event that the value of the item is insignificant, the seller may donate it to charity and in this case no refund is owed to the buyer. 15 days before the expiration of the 6-month retention period, the seller informs the buyer of the intended sale or donation of the item, and after the sale, also of the achieved price and amount of costs, and of the transfer of the remaining purchase price to the buyer’s transaction account.

Items with open packaging

Items with opened packaging have been returned to jana splet, d.o.o. and may have minor defects (damaged packaging/item, open packaging, etc.) and will be resold. The type of defect or the condition of the item is stated in writing for each item (both in the item description and on the invoice).

Items returned to Jana splet d.o.o. are inspected, so despite the return, open packaging, etc. still allow normal operation. For this reason, a new warranty period has also been duly determined, which is indicated in writing next to each item.

If the returned item does not work, the customer is entitled to warranty repair and to withdraw from the contract within the same terms as for other items.

Defect type of item labeled Open packaging

  • Open packaging: The item has an open packaging, but it is perfectly functional and complete. The price is additionally reduced, the specified warranty period applies.
  • Damaged packaging: The item has damaged, incomplete or non-original packaging, but it is in perfect working order. The price is additionally reduced, the specified warranty period applies.
  • Damaged item: The item has minor aesthetic damage, may show signs of use and may have damaged packaging. The price is additionally reduced, the specified warranty period applies.
  • Used item: The item was returned by the buyer. It has been used and may have slightly damaged packaging. The price is additionally reduced, the specified warranty period applies.
  • Item serviced: The item was serviced at an authorized service center. The item is in perfect working order. The price is additionally reduced, the specified warranty period applies.

Delivery

Our contractual partners for the delivery of parcels in the territory of Slovenia are Pošta Slovenije and Gold ekspres, but Jana splet, d.o.o. reserves the right to choose another delivery service if it can fulfill the order more efficiently. 

Protection of personal data

JJSPA undertakes to permanently protect all personal data of the user in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 and ZVOP-1.

All detailed information about the processing of personal data can be found in Privacy Policy. The user must be aware that he is obliged to provide the online trader with his personal data in a correct and true form, and he is also obliged to inform the online trader of any change in his data. By accepting these terms and conditions, the user confirms that the personal data he has provided is correct.

Communication

Jana splet, d.o.o. will contact the user via means of remote communication only if the user does not expressly oppose it, and in accordance with the provisions of ZEKom-1.

Advertising electronic messages Jana splet, d.o.o./JJSPA will contain the following components:

  • will be clearly and unambiguously marked as advertising messages,
  • the sender Jana splet, d.o.o./JJSPA will be clearly visible,

Jana splet, d.o.o. has the right to use the content of the opinion or comment indefinitely and for any purpose that is in the business interest of Jana splet, d.o.o., including publication in advertisements or other marketing communications. At the same time, the author of the opinion declares and guarantees that he is the owner of the material and moral copyrights for the written opinions and comments, and that he transfers these rights to Jana splet, d.o.o. non-exclusively and indefinitely.

Trgovina Jana is aware that an essential feature of consumer disputes is the disproportion between the economic value of the claim and the time and costs required to resolve the dispute, which is also the main obstacle for the consumer not to initiate a dispute before the court. That is why Jana splet, d.o.o. does its best to resolve any disputes amicably.

Out-of-court settlement of consumer disputes

According to the legal norms of Jana invest d.o.o. does not recognize any provider of out-of-court resolution of consumer disputes as competent to resolve a consumer dispute that a consumer may initiate in accordance with the Act on Out-of-Court Resolution of Consumer Disputes.

Trgovina Jana, which as a provider of goods and services enables online shopping in the territory of the Republic of Slovenia, publishes on its website an electronic link to the platform for the online resolution of consumer disputes (SRPS). The platform is available to consumers here.

The mentioned regulation comes from the Act on the Out-of-Court Settlement of Consumer Disputes, Regulation (EU) No. 524/2013 of the European Parliament and of the Council on the online resolution of consumer disputes and the amendment of Regulation (EC) no. 2016/2004 and Directive 2009/22/EC.
